Holiday Pay

You may remember that a recent Supreme Court ruling overturned the way in which holiday pay should be calculated for employees who work irregular hours or only part of a year. Essentially, this said that the ACAS guidance had been wrong for years.

Because of the confusion of holiday pay and perceived unfairness, the government introduced legislation to revert to the previously accepted, and simpler, position. The law takes effect from April 2024.

This means that the minimum holiday can be calculated as 12.07% of hours worked.
